This Website is owned by PLAY HAWKERS, S.L. (hereinafter, “HAWKERS”), a company registered under Spanish law, with Tax Identification Number (NIF) B-54754718 and recorded in the Commercial Register of Alicante, Entry 1553 of Journal 20, Volume 3749, Page 168, Sheet A-138493, Entry 5, with its registered office at Calle Marie Curie, 34, Polígono Industrial, 03203, Elche (Alicante).

By accepting this Privacy Policy, the user (hereinafter, the “User” or “Users”) is informed and gives their free, informed, specific and unequivocal consent for the personal data provided via the website located at URL www.hawkers213.com (hereinafter, the “Website”) to be processed by HAWKERS, along with any browsing data and other information the User may provide in future.

5. What User data will HAWKERS process?

HAWKERS will process the following categories of User data:

The consents obtained for the above purposes are independent, meaning the User may revoke one without it affecting the others.

7. Who will the User’s data be shared with?

User data may be shared with:

  • Public authorities, in cases provided for by law.
  • HAWKERS GROUP, S.L., the parent company, based on the legitimate interest granted by data protection regulations, for administrative purposes relating to the management of the corporate group.
  • Companies belonging to the Hawkers Group (as defined above), for the purpose of sending the User personalised commercial communications by electronic and/or conventional means, if the User gives their consent by ticking the relevant box.
  • Companies in the marketing sector or those associated with Adigital, as well as companies in the telecommunications, finance, leisure, consumer goods, automotive, energy and water sectors, NGOs, or the jewellery and precious stones sector, for the purpose of sending commercial communications by electronic and conventional means, related to those sectors, provided the User has given their consent by ticking the relevant box.

8. International data transfers

The User is informed that HAWKERS uses the services of Shopify, Google, Microsoft, Dropbox, Mailchimp, Atlassian, Amazon Web Services and Slack, whose servers are located in the United States, which involves an international transfer of data. However, these international data transfers are regulated, as the aforementioned entities are certified under the Privacy Shield Framework.

9. Retention of the data

The User’s data will be retained for the following periods:

9.1. Data provided for completing a purchase:

  • Data used to manage, process, dispatch and track purchases will be retained for the duration of the contractual relationship and once it ends, for the applicable legal limitation period for any legal actions arising from it.
  • Data used to contact the User in order to complete their order if they have saved their shopping basket or added products to it without finalising payment will be retained for 180 days.
  • Data related to satisfaction and quality surveys will be retained for five (5) years.

9.2. Data provided via out-of-stock product forms:

  • Will be processed until the User is notified that the product is back in stock. If it does not become available, the data will be retained for six (6) months.

9.3. Data provided through contact forms:

  • Will be retained for the time necessary to process and respond to the request, and thereafter for the limitation period for any legal actions arising from it.

9.4. Data provided through collaboration forms:

  • Will be retained for the duration of the contractual relationship and once ended, for the applicable legal limitation period for any legal actions arising from it.

9.5. Data provided for sending the Newsletter:

  • Will be retained until the User withdraws the consent given for that purpose.

9.6. Data provided to obtain discounts or participate in promotions:

  • Will be retained until the promotion ends and once ended, for the applicable legal limitation period for any legal actions arising from it.

9.7. Data used for the sending of commercial communications:

  • Will be processed until the User objects or withdraws their consent. Data used to build commercial profiles using third-party sources will under no circumstances refer to a period longer than three (3) years.

10. Commercial and promotional communications

One of the purposes for which HAWKERS processes personal data provided by Users is to send them commercial communications containing information about products, services, promotions, offers, events or news that may be of interest.

11. User responsibility

The User:

  • Guarantees that they are over sixteen (16) years of age and that the data provided to HAWKERS is true, accurate, complete and up to date. For these purposes, the user is responsible for the veracity of all the data that they communicate and will keep the information provided properly updated, in a way that reflects their actual situation.
  • Guarantees that, where they provide data relating to third parties, they have informed said third parties of the content of this document. Likewise, guarantees that they have obtained the third parties’ consent to provide their data to HAWKERS for the purposes indicated.
  • Will be held liable for any false or inaccurate information provided via the Website and for any direct or indirect damage caused to HAWKERS or to third parties as a result.

12. Exercise of rights

The User may contact HAWKERS in writing, either at the address provided in the header of this Policy or via email at hello@hawkersco.com , at any time and free of charge, in order to:

  • Obtain confirmation as to whether or not HAWKERS is processing personal data concerning the User.
  • Access their personal data.
  • Rectify inaccurate or incomplete data.
  • Request the erasure of their data when, among other reasons, the data is no longer necessary for the purposes for which it was collected.
  • Request the restriction of processing where any of the conditions established in the data protection regulations are met.

13. Security measures

HAWKERS will always process the User’s data with the utmost confidentiality, observing the mandatory duty of secrecy for it in accordance with applicable regulations. The company will adopt the necessary technical and organisational measures to ensure the security of the data and prevent its alteration, loss, unauthorised processing or access, considering the state of the art, the nature of the data stored and the risks to which it is exposed.

14. Amendments

HAWKERS reserves the right to revise this Privacy Policy whenever it deems appropriate, in which case the User will be informed accordingly. For this reason, Users are advised to review this statement regularly to consult the most recent version of the HAWKERS Privacy Policy.

15. Acceptance and Consent

The User declares that they have been informed of the terms and conditions relating to the protection of personal data and accepts and consents to the automated processing of such data by HAWKERS in the manner and for the purposes described in this Privacy Policy.
